You're a first offender only if you've never had a DUI conviction or DUI court supervision and haven't had a summary suspension in the 5 years before this arrest.
The Hearing
The petition asks the circuit court for a hearing and states its grounds. Filing in the first few weeks gives the hearing a chance to happen before day 46.
We can subpoena the arresting officer, who then answers questions under oath about the stop, the roadside tests and the warnings.
The judge sustains the suspension or rescinds it. The officer's testimony stays on the record for the criminal case.

About Pat
As a prosecutor for DuPage County and the Village of Downers Grove, I handled roughly a thousand summary suspension hearings, some days five to ten of them. I know which parts of the sworn report the State relies on, and where the paperwork and the video can disagree.
A suspension hearing can turn on small details, like the time on the notice or which box the officer checked. I check those details against the squad video before the officer testifies.
Reviews
These reviews describe individual clients' own cases. Every case is decided on its own facts, and prior results do not guarantee a similar outcome.
I couldn’t be more grateful to Pat for helping me through my DUI case. From the very beginning, he was honest, responsive, and genuinely cared about the outcome. He walked me through every step, answered all my questions, and got my case dismissed! … I highly recommend him.
Una firma de abogados sería, honesta, profesional, me sentí muy seguro de que me ayudarían en mi caso de DUI, en el cual lucharon por mi inocencia y el resultado fue excelente. No salí culpable veredicto final del Juez, NOT GUILTY, (no culpable) gracias Dolci/Weiland.
Our English translation: A serious, honest, professional law firm. I felt very confident that they would help me with my DUI case, in which they fought for my innocence, and the result was excellent. I was not found guilty. The judge's final verdict: NOT GUILTY. Thank you, Dolci/Weiland.
My DUI caused me tremendous worry and anxiety. Finding the right lawyer was stressful. I was lucky to select Dolci & Weiland as my law firm. Mr. Weiland made me feel extremely comfortable with his knowledge of the DUI process and what I could expect in court. … Within just a few court dates, I was thrilled when he told me that my case had been dismissed. I would 100% recommend Dolci & Weiland for your DuPage DUI case.
I hired Patrick and Dominick in September 2013 after a second DUI charge. I thought my life was over, Dupage county and Lombard didn’t really have their stuff together and they found holes in the arrest in the night in question. After a year in a half of continuances Patrick and Dominick got the case dismissed. But Dupage decided to re-file and charge with the 6 charges again. This took another 6 months almost 2 years of dealing with this. July 17, 2015 the bench trial finally comes I get my date in court again. Dominick just torn apart the arresting officer and made her, the Lombard police department, and DuPage look dumb is putting it nicely. On the grounds of independent recall a term used to dismiss my case and no conviction and no re-filing or recharging me ever. Walked out with tears of happiness and joy. Thank you Patrick and Dominick anybody that has a DUI hire this two it was money well spent.
In Depth
You’re holding a sheet of paper the officer handed you at the station along with your ticket. It’s the notice of summary suspension, and it means your driver’s license will be suspended soon, even though no judge has found you guilty of anything.
A DUI arrest starts two clocks at once. One is the criminal case. The other is your license, and that one moves first. The suspension takes effect on the 46th day after you got that notice. You have 90 days from the same date to file a petition asking a judge to rescind it. The License Clock on this page works out both dates from your arrest date.3, 4
The clock and the tables are estimates, not legal advice. They assume the notice was handed to you at the arrest. If it came later by mail, after a blood or urine result, your dates run from that notice instead.
The length depends on two things: whether you failed a test or refused one, and whether you count as a first offender.1
| Situation | Suspension length |
|---|---|
| First offense, failed test | 6 months |
| First offense, refused testing | 12 months |
| Repeat offense (any prior DUI conviction or supervision, or a summary suspension in the last 5 years), failed test | 1 year |
| Repeat offense, refused testing | 3 years |
A “failed test” means a breath or blood result of 0.08 or more, a THC level over the legal limit, or certain drugs in your system. You’re a first offender only if you’ve never had a DUI conviction or DUI court supervision and haven’t had a summary suspension in the 5 years before this arrest.2 A refusal after a crash that injured or killed someone leads to a revocation, which follows different rules.
| Event | When it happens |
|---|---|
| Suspension takes effect | The 46th day after the notice was given to you |
| Petition to rescind must be filed | Within 90 days after the notice |
Count the day the officer handed you the notice as day zero. The suspension takes effect on day 46, about six and a half weeks later, and the last day to file a petition to rescind is day 90, about three months later. The License Clock on this page counts both dates for you from your arrest date.
The petition is a written request for a hearing in the circuit court where your DUI ticket is filed. It runs like a civil case. The petition has to state its grounds, and the law limits the hearing to four questions:4
The judge can decide the hearing from the officer’s own reports, but we can subpoena the officer to testify. Then the officer answers questions under oath about the stop, the roadside tests and the warnings, and that testimony stays on the record for the criminal case. At the end, the judge sustains the suspension or rescinds it.
I handled roughly a thousand of these hearings from the State’s side, for the DuPage County State’s Attorney and the Village of Downers Grove. I know which parts of the sworn report the State relies on, and where the paperwork and the video can disagree. A hearing to challenge the suspension can turn on small details, like the time on the notice or which box the officer checked.
If you’re a first offender, the Secretary of State mails you a notice about a monitoring device driving permit, called an MDDP.5 It lets you drive for any purpose, at any time, in a vehicle with a breath alcohol ignition interlock device (BAIID), a small breath tester wired into the ignition.
A few rules come with it:
An MDDP isn’t available if you’re under 18, if someone suffered great bodily harm or died, or if your license was otherwise invalid. Repeat offenders can’t get one at all.
The petition doesn’t pause the suspension.4 It goes into effect on day 46 whether or not you’ve filed. The court has to hold the hearing within 30 days after it receives your request or within 30 days after the first court date on your ticket. File in the first few weeks, and the hearing may happen before the suspension starts. File on day 89, and the suspension is already running while you wait for a ruling.
Filing early also gives us time to request the squad video, the sworn report and the breath test records before the officer testifies.
Call me at (630) 261-9098 with your notice in hand. We’ll find the date on it, count forward to day 46 and day 90, and decide whether a petition makes sense in your case. If the window has already closed, call anyway. We can still talk through the MDDP and how the criminal case affects your license.
Before You Call
Yes. Calling me or sending the form for a case review costs nothing, and it doesn't commit you to hiring me.
No. The suspension takes effect on day 46 whether or not a petition is pending. The court has to hold the hearing within 30 days after it gets the request, so filing in the first few weeks can bring the hearing before the suspension starts.4
Tell me at the start. A DUI or a test refusal can disqualify a commercial license for at least a year, even if you were in a personal car, and you can't drive a commercial vehicle on a monitoring device driving permit.6
Call anyway. We can still talk through the monitoring device driving permit and how the criminal case affects your license.
